1. About MOQ Exams

MOQ Exams is a competitive examination preparation application designed to help users practise questions, take mock tests, follow study plans, review current affairs and participate in educational and community features.

The app may include features such as quizzes, mock examinations, leaderboards, battles, groups, chat, study materials, mcoins, premium features, prizes and an AI-powered study assistant.

2. Acceptance of these Terms

By downloading, installing, accessing or using MOQ Exams, you confirm that you have read, understood and agreed to these Terms and Conditions.

These Terms apply to your use of the MOQ Exams mobile application and related services.

If you use the app on behalf of another person or organisation, you confirm that you have authority to accept these Terms on their behalf.

3. Eligibility

MOQ Exams is intended for users aged 18 years and above.

You must provide accurate information when creating your account and must not create an account using another person's identity or information.

We may restrict or terminate accounts that we reasonably believe violate the eligibility requirements or applicable law.

4. Account Registration and Security

Certain features require you to create an account. Authentication may use mobile OTP verification and/or supported third-party sign-in methods such as Google Sign-In.

You agree to:

• Provide accurate and current information.
• Keep your account information updated.
• Use only your own account.
• Not share your authentication codes with others.
• Notify us if you believe your account has been compromised.

You are responsible for activity performed through your account unless the activity resulted from our failure to apply reasonable security measures.

5. Use of the App

You may use MOQ Exams only for lawful educational, competitive and personal purposes permitted by these Terms.

You must not use the app to:

• Break any applicable law or regulation.
• Attempt to gain unauthorised access to the app or its servers.
• Interfere with the normal operation of the service.
• Use bots, scripts or automated systems without our permission.
• Manipulate scores, rankings, coins or competition results.
• Impersonate another user or organisation.
• Upload malicious software or harmful files.
• Abuse, threaten or harass other users.
• Use the service to distribute unlawful or harmful content.

6. Examination Content and Study Materials

MOQ Exams may provide questions, answers, explanations, mock tests, current affairs, notes, study materials, exam-related information and other educational content.

We make reasonable efforts to maintain the quality and accuracy of educational content. However, we do not guarantee that every question, answer, explanation, current-affairs item, syllabus reference or examination information will always be complete, current or error-free.

Official examination notifications, eligibility criteria, dates, vacancies and other official requirements should always be verified with the relevant official authority.

Educational content available through MOQ Exams should not be treated as a guarantee of examination success, employment, qualification or selection.

7. Scores, Rankings and Leaderboards

The app may calculate scores, ranks, XP, streaks, tiers, accuracy and other performance indicators.

Rankings may depend on factors including correct answers, speed, test results, participation, season rules and other app-defined scoring systems.

We may correct, recalculate or remove scores where we identify technical errors, cheating, manipulation or other unfair activity.

8. Battles, Challenges and Competitions

MOQ Exams may provide quizzes, battles, challenges, contests or other competitive features.

Each competition may have its own eligibility rules, entry requirements, scoring method, duration and prize conditions.

Competition results may be cancelled or adjusted where there is evidence of cheating, technical manipulation, fraudulent activity or a material system error.

Where a competition involves a cash prize or other reward, the specific prize terms displayed in the app will form part of the applicable competition rules.

9. Coins (mcoins)

MOQ Exams may provide virtual credits called mcoins.

Mcoins may be used for features such as additional AI usage, paid group access, locked study materials or other features displayed in the app.

• Mcoins are virtual in-app credits.
• Mcoins are not legal tender.
• Mcoins do not represent a bank deposit or financial instrument.
• Mcoins cannot be transferred between users unless the app expressly allows it.
• Mcoins cannot be redeemed for cash except where a specific feature expressly provides an eligible cash payout.
• We may correct coin balances affected by technical errors, fraud or unauthorised activity.

10. Premium Features and Payments

Certain features, subscriptions, premium content, coin packages or other services may require payment.

Prices applicable to a purchase will be displayed before you complete the transaction.

Payments may be processed through third-party payment providers such as Razorpay or through applicable platform payment systems.

By completing a purchase, you authorise the applicable payment provider to process the transaction according to the payment method selected by you.

We do not store your full card number, CVV, UPI PIN or net-banking password.

11. Prizes and Payouts

Certain competitions or features may provide eligible users with cash prizes or other rewards.

Prize eligibility, amount, conditions and payout requirements will be specified in the applicable competition or feature rules.

To receive an eligible cash prize, you may be required to provide accurate payment and verification information, such as a UPI ID, bank account information, IFSC and PAN where required.

We may withhold or delay a payout where verification, fraud checks, tax requirements, payment-provider requirements or applicable law require us to do so.

Applicable taxes, deductions or reporting requirements may apply to prizes.

12. Refunds and Cancellations

Refunds are subject to the nature of the purchase, applicable payment-provider rules, platform rules and applicable consumer law.

Where a refund is required by applicable law, we will process it in accordance with that law.

13. AI Study Assistant (AIRA)

AIRA is provided as an educational assistance feature. It may use third-party AI models to generate responses.

AI-generated answers may contain mistakes, inaccuracies, outdated information or incomplete explanations.

You should independently verify important information, especially examination eligibility, official dates, legal information, financial information and other information where an error could have significant consequences.

AIRA does not guarantee examination success or any particular educational outcome.

Your use of AIRA is also subject to the data-processing terms described in our Privacy Policy.

14. Chat, Groups and Voice Halls

MOQ Exams may provide private chats, groups, communities, voice halls and other communication features.

You agree not to use these features to:

• Harass, threaten or abuse another person.
• Send spam or unsolicited promotional messages.
• Share unlawful or harmful content.
• Share sexually explicit content or content involving exploitation.
• Promote fraudulent schemes.
• Distribute malware or harmful files.
• Impersonate another person.
• Share examination material in violation of applicable rights.

Reported content may be reviewed by authorised moderators for safety, moderation and enforcement purposes.

15. User Content

Users may be able to submit profile information, questions, messages, photos, videos, audio, comments, group posts and other content.

You remain responsible for the content you submit.

By submitting content, you confirm that you have the necessary rights and permissions to submit that content and that your content does not violate these Terms or applicable law.

You grant MOQ Exams a limited, non-exclusive, royalty-free licence to host, store, reproduce and display your submitted content solely as necessary to operate, maintain, moderate and provide the relevant app features.

We may remove content that violates these Terms, applicable law or our community rules.

16. Prohibited Activities

You must not attempt to:

• Reverse engineer or decompile the app except where permitted by law.
• Modify or distribute unauthorised versions of the app.
• Access another user's account.
• Manipulate APIs, requests, scores or competition results.
• Use automated scripts, bots or scraping tools without written permission.
• Exploit bugs for personal benefit.
• Attempt to bypass security or authentication controls.
• Upload viruses, malware or malicious code.
• Use the app for unlawful activities.
• Attempt to interfere with the availability or performance of the service.

17. Fair Play and Anti-Cheating

MOQ Exams is designed to provide a fair competitive environment.

We may use technical and behavioural measures to detect suspicious activity, unusual patterns, automated use, multiple-account abuse or manipulation of competition results.

If we reasonably determine that an account has cheated or manipulated the system, we may:

• Remove scores or rankings.
• Cancel competition results.
• Remove incorrectly awarded mcoins or rewards.
• Restrict competition access.
• Suspend or terminate the account.

18. Intellectual Property

Unless otherwise stated, MOQ Exams and its licensors own or control the intellectual-property rights in the app, software, branding, logos, design, interface, original questions, explanations, graphics and other original materials provided by MOQ Exams.

You may use the app and its content only for personal and permitted educational purposes.

You must not copy, reproduce, redistribute, sell, publish, modify or commercially exploit MOQ Exams content without prior written permission, except where applicable law expressly permits such use.

19. Third-Party Services

MOQ Exams may integrate third-party services including authentication, payment, cloud storage, AI, messaging, audio and notification providers.

Your use of those services may also be subject to the third party's own terms and policies.

We are not responsible for the independent operation, availability or policies of third-party services.

20. Availability and Changes to the App

We may update, modify, suspend or discontinue all or part of MOQ Exams from time to time.

We do not guarantee that the app will always be available, uninterrupted, secure or error-free.

Maintenance, software updates, network failures, third-party outages, security incidents and circumstances beyond our reasonable control may affect availability.

21. Account Suspension and Termination

We may suspend, restrict or terminate an account where reasonably necessary to:

• Enforce these Terms.
• Prevent fraud or abuse.
• Protect users or the platform.
• Investigate suspicious activity.
• Comply with applicable law or legal requests.
• Protect our intellectual-property rights.

Where appropriate and legally permitted, we may provide notice or an opportunity to address the issue.

Termination does not remove obligations that by their nature should continue after termination, including intellectual-property rights, payment obligations, disclaimers and limitation-of-liability provisions.

22. Disclaimers

MOQ Exams is provided on an "as available" and "as is" basis to the extent permitted by applicable law.

We do not guarantee:

• That you will pass any examination.
• That you will obtain employment or selection.
• That every educational answer will be error-free.
• That examination information will always be current.
• That the service will always be available without interruption.
• That AIRA will always provide accurate information.

Nothing in these Terms excludes or limits rights or remedies that cannot legally be excluded under applicable law.

23. Limitation of Liability

To the maximum extent permitted by applicable law, MOQ Exams will not be liable for indirect, incidental, special or consequential losses arising from your use of the app.

This includes, where legally permitted, loss of data, loss of opportunity, loss of profits or interruption resulting from your use of the service.

Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for fraud, wilful misconduct or other matters that the law does not permit us to exclude.

24. Indemnification

To the extent permitted by applicable law, you agree to be responsible for claims, losses or reasonable expenses arising from your unlawful use of the app, violation of these Terms, infringement of another person's rights, or content that you submit to the service.

25. Privacy

Our Privacy Policy explains how MOQ Exams collects, uses, stores and shares personal data.

By using MOQ Exams, you acknowledge that you have had the opportunity to review the Privacy Policy.

26. Changes to these Terms

We may update these Terms when the app, features, services, business model or applicable legal requirements change.

When we make material changes, we may provide notice through the app or other appropriate means where required.

The updated Terms will become effective on the date stated at the beginning of the revised Terms.

Your continued use of MOQ Exams after the effective date means that you accept the updated Terms to the extent permitted by applicable law.

27. Governing Law and Jurisdiction

These Terms are governed by the laws applicable in India, without prejudice to any mandatory consumer or other statutory rights that may apply to you.

Subject to applicable law, disputes relating to these Terms or your use of MOQ Exams will be subject to the jurisdiction of the competent courts in Kerala, India.
